Thanks to David Rudovsky for representing the Guild and achieving a victory in court today on the matter of the subpoena that NYC issued in early December 2004. The subpoena asked for information related to legal observers at the 2002 World Economic Forum protests in NYC. Earlier today Magistrate Judge Gorenstein quashed the subpoena. We fought against turning over the materials, citing First Amendment grounds and also suggesting multiple challenges down the road if this process went further, along with the lack of strong relevancy and right to association.

Gorenstein said the NLG and legal observers have First Amendment rights to associate, that NLG legal observers are likely to sympathize with goals of NLG and that if the city were permitted to question them about whether they attended a certain demonstration, it would have a chilling effect. Balancing the marginal relevance of the information requested the subpoena was quashed.

In addition, the NYC Chapter of the Guild filed a motion to intervene, which was granted.
